Types of Brain Injuries

In the most general terms, brain injuries are divided into two categories: traumatic and non-traumatic.

Non-Traumatic Brain Injuries

Non-traumatic brain injuries, which are often referred to as “acquired brain injuries” (ABIs), are the result of internal factors, such as oxygen deprivation or pressure from a brain tumor.

Traumatic Brain Injuries

As the name implies, traumatic brain injuries (TBIs) are the result of catastrophic events and external factors that cause severe damage to the brain.

Traumatic brain injuries are further classified as either open-head or closed-head injuries. While an open-head injury involves a penetrating object that enters the skull and causes damage to the brain, a closed-head injury occurs when the skull is not fractured but external forces are great enough to cause traumatic brain injury.

There are several different types of traumatic brain injuries. The most common include:

  • Concussions: A concussion occurs when there is a sudden blow to the head or when external force causes the head to make impact with an outside object or surface. Though they are considered a relatively “mild” TBI, concussions should still be treated by a medical professional.
  • Contusions: “Contusion” is the medical term for a bruise; a brain contusion, therefore, is a bruise that forms on the brain. Brain contusions are often caused by a blow to the head and typically occur in conjunction with another brain injury, such as a concussion.
  • Diffuse Axonal Injury: A diffuse axonal injury (DAI) occurs when the brain moves violently within the skull, leading to microscopic tears (“shearing”) in the connections within the brain. Depending on the size of these tears, DAIs can be catastrophic or even fatal.
  • Coup-Contrecoup: A coup-contrecoup injury occurs when an external force impacts the head, causing the brain to slam against the opposing side of the skull. This results in two points of injury and can lead to massive brain damage.

Common Causes of Brain Injuries

These and other TBIs are often caused by:

This is not an exhaustive list; other serious accidents and events can—and frequently do—lead to devastating brain injuries.

What to Do After a Brain Injury

The first and most important thing to do after you have sustained a brain injury or suspected brain injury is to seek medical attention. Left untreated, brain injuries can worsen and may be fatal. Always seek treatment from a qualified medical professional if you believe you may have suffered a brain injury and if you are in an accident with another individual who is exhibiting symptoms of a TBI, call 911.

Next, if you believe that the accident that caused your brain injury or your loved one’s brain injury was the result of someone else’s negligence, reach out to a personal injury lawyer. A skilled attorney can help you protect your rights, including your right to fair compensation. We strongly advise that you contact one of our TBI lawyers in Charlotte before speaking to any insurance adjusters, as these individuals will often do everything they can to dispute or even deny your claim. You could unknowingly jeopardize your ability to seek maximum compensation if you admit fault or downplay your injuries to an insurance adjuster.

It is also important that you act quickly, as you only have three years from the date of the accident to file your claim if the claim does not result in a wrongful death. However, the sooner our team can begin conducting an investigation into the accident and gathering evidence to support your claim, the better.

What Is Usually Covered in a Brain Injury Settlement?

Brain injury compensation is similar to other personal injury settlements in that it seeks to compensate the victim for the following types of damages:

  • Medical costs (surgery, hospital stays, medication, physical therapy, assisted living etc.)
  • Pain and suffering (and other emotional damages including loss of consortium or loss of enjoyment of life)
  • Lost wages or reduced earning capacity if your injuries render you unable to return to the same profession as before
  • Damage to personal property (especially if you were injured in a car accident)

Since traumatic brain injuries tend to have more serious long-term effects on the victim, it is not uncommon for most TBI settlements to be over $100,000, depending on the specifics of the case. When you meet with Attorney Payne, we can discuss your case and what the possible value of your TBI settlement may be.
